1. About These Terms

These Terms of Service ("Terms") govern your use of Speak Your Mind and the related That Language Guy website and services (together, the "Service"). The Service is operated by Hsieh Jen Ting, an individual operator based in Taiwan, under the name That Language Guy ("That Language Guy," "we," "us," or "our").

By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Who May Use the Service

Speak Your Mind is intended for users aged 16 or older. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian.

Paid subscriptions must be purchased by an adult or with authorization from the payment-account holder. The Service is not directed to children under 13.

3. What Speak Your Mind Provides

Speak Your Mind is an AI-assisted speaking coach. It helps language learners express the intent behind their thoughts in natural, socially appropriate language and provides learning explanations, pronunciation support, and related features.

The Service is educational. It is not a certified translation service, professional interpreting service, examination authority, or substitute for legal, medical, financial, safety, or other professional advice.

AI-generated content can occasionally be inaccurate, incomplete, inconsistent, or unsuitable for a particular relationship or situation. You remain responsible for deciding whether and how to use an output, especially in important or sensitive communications.

4. Accounts

You must sign in through a supported authentication method to generate or save content. You agree to provide accurate account information, keep access to your account secure, and notify us at [email protected] if you believe your account has been misused.

Your account is personal to you. You may not sell, share, transfer, or use it to provide generation access to others as a paid or automated service.

5. Plans and Generation Allowances

The current advertised plans are:

  • Free Trial: 20 generations for the lifetime of the account;
  • Monthly: 600 generations per monthly billing period; and
  • Annual: everything included in the Monthly plan, including 600 generations per month, billed annually.

A generation is generally counted when the Service successfully produces an AI response. Requests rejected before generation because of authentication, input limits, or service protections should not consume an allowance. If generation fails because of a confirmed service error, the Service is designed to release the reserved generation where technically possible.

Monthly allowances do not accumulate or roll over into later periods. Unused generations expire when the applicable usage period ends. Account deletion does not transfer unused generations or paid access to another account.

We may apply reasonable technical limits to input length, request frequency, and automated activity to protect service quality, availability, and cost. We will not materially reduce an active paid plan's advertised allowance during its already-paid subscription period without an appropriate remedy required by law.

6. Subscriptions and Payment

Paid plans renew automatically at the interval shown at checkout until cancelled. Prices, currencies, taxes, and the total amount due will be displayed before purchase.

Lemon Squeezy acts as the merchant of record for paid purchases. Lemon Squeezy processes checkout, payment, applicable sales taxes, receipts, refunds, chargebacks, and related billing administration under its own buyer terms and privacy practices. Charges may appear on your statement using a Lemon Squeezy descriptor.

We may change prices for future purchases or renewal periods. Any change affecting an existing subscription will be communicated and applied in accordance with the checkout terms and applicable law.

7. Cancellation, Expiration, and Account Deletion

You may cancel a subscription to stop future renewals. Unless otherwise stated at checkout or required by law, cancellation does not immediately end access: paid access continues until the end of the current billing period shown in your billing information. After that date, the subscription expires and paid access ends.

Cancelling a subscription and deleting an account are different actions:

  • Cancellation stops future renewal while preserving the account and remaining paid access through the current billing period.
  • Immediate account deletion permanently removes the learning account and ends access immediately, including any unused paid time.

Before immediate deletion of an account with an active subscription, future renewal must first be cancelled. Deleting an account does not automatically create a refund for unused time. Refund eligibility is governed by our Refund and Cancellation Policy and any rights that cannot legally be excluded.

8. Acceptable Use

You may not:

  • use the Service in violation of law or another person's rights;
  • attempt to bypass account, quota, rate-limit, payment, or security controls;
  • use bots, scripts, scraping, or other automated means to access the Service without our written permission;
  • reverse engineer, disrupt, overload, damage, or probe the Service or its infrastructure;
  • use another person's account or payment method without permission;
  • upload malware or attempt to gain unauthorized access to data or systems;
  • use the Service to create or distribute unlawful, abusive, fraudulent, or seriously harmful material; or
  • resell, sublicense, or commercially redistribute the Service or generated access without our written permission.

We may restrict or suspend activity reasonably believed to threaten users, infrastructure, legal compliance, or the continued operation of the Service.

9. Your Content and Saved Lessons

You retain any rights you have in the text you submit. You give us a limited permission to process that text solely as needed to provide, secure, maintain, and improve the Service, including sending it to the service providers described in our Privacy Policy.

You are responsible for the content you submit and for having the right to submit it. Do not enter passwords, payment-card information, government identification numbers, medical records, or other highly sensitive information into the generation box.

Generated output may not be unique. Other users may receive similar language because common ideas and phrases can have similar natural expressions.

10. Our Content and Intellectual Property

The Service, brand, interface, prompt design, learning structure, explanatory format, website content, and other materials supplied by That Language Guy are owned by us or our licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable right to use the Service and its outputs for your own learning and communication. This does not give you ownership of the Service, its underlying systems, or its protected learning materials.

11. Service Changes and Availability

We may improve, replace, add, or remove features and supported languages. We may also perform maintenance or temporarily limit access for security, reliability, legal, or technical reasons.

We aim to provide a reliable Service, but we do not guarantee uninterrupted availability, that every output will be error-free, or that a particular browser voice or third-party service will always remain available.

If we permanently discontinue a paid Service before the end of an already-paid period, we will provide any remedy required by applicable law and may provide an appropriate refund or credit.

12. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate an account for a material or repeated breach of these Terms, fraud, non-payment, security threats, unlawful use, or conduct that materially harms the Service or other users.

Where reasonable, we will provide notice and an opportunity to correct the issue. We may act immediately when necessary to prevent harm, comply with law, or protect accounts and infrastructure.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded where you live.

14. Limitation of Liability

To the fullest extent permitted by law, That Language Guy will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, business, data, goodwill, or opportunities resulting from your use of or inability to use the Service.

To the fullest extent permitted by law, our total liability arising from the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim. For a free user, the total will not exceed US$50.

These limits do not apply where liability cannot legally be limited, including liability arising from fraud, intentional misconduct, or other categories protected by applicable law.

15. Governing Law and Consumer Rights

These Terms are governed by the laws of Taiwan, without regard to conflict-of-law rules. Courts with jurisdiction in Taiwan may hear disputes relating to these Terms.

If mandatory consumer-protection law where you live gives you rights or permits you to bring a claim in another jurisdiction, these Terms do not take those rights away.

16. Changes to These Terms

We may update these Terms as the Service changes. We will update the date above and provide reasonable notice of material changes where required. Changes will not retroactively remove rights relating to an already-paid period where prohibited by law.

17. General Terms

If one part of these Terms is found unenforceable, the remaining parts continue to apply. A delay in enforcing a provision does not waive our right to enforce it later. You may not transfer your account or these Terms without our permission. We may transfer these Terms as part of a legitimate reorganization or transfer of the Service, subject to applicable law.
